No. 1: “What’s New in the SearchPoint Library? Updated Information on Remote Work”
Working from home raises concerns regarding compliance with federal data privacy and security laws. ACA SearchPoint document #1301 highlights these important issues, such as the need to comply data security laws like the Gramm-Leach-Bliley Act and the new remote work provision in Nevada. September/October 2023
No. 2: “Transformation and Hard Work”
This column, written by ACA International CEO Scott Purcell, highlights the association’s 2023 Accomplishments Report: “As you read about the great success we’ve had in thwarting truly harmful legislation (which is not apparent on your financial statement because it’s the absence of a negative impact), those results, directly benefiting you, came from ACA’s very hard work, as well as transformation of how we do our work.” March/April 2023

State and federal regulators have been increasingly focused on exposing companies’ use of “dark patterns:” deceptive online practices and other hurdles that make it difficult for consumers to stop recurring charges or understand terms and conditions. March/April 2023

The Federal Communications Commission’s modified rule on call exemptions and obtaining consumers’ consent took effect in July. The FCC issued a revised order on TCPA exemptions with updates to its rule requiring prior express written consent in response to a petition from ACA and a coalition of joint industry trade associations. 2022 brought a number of noteworthy judicial developments. For example, the horde of Hunstein copycats that had filed suit across the country found themselves almost entirely washed out of federal courts, as even the 11th Circuit itself reversed course and vacated the devastating and misguided 2021 panel opinions about transmissions of consumer data to letter vendors, thus essentially killing Hunstein. No. 7: “Coalition Supports FTC Rule on Business Impersonation Scams”
ACA joined a coalition of more than 200 trade associations and professional organizations supporting an expedited final rule from the Federal Trade Commission to stop government and business impersonation scams. July/August 2023
