ACA International CEO Scott Purcell and Vice President of State Government Affairs Andrew Madden shared updates on industry issues ranging from rule activity at the Federal Communications Commission to tackling duplicative state and federal laws and regulations on a recent episode of the Credit and Collection News Podcast.
Host Steve Ruderman, president of Credit and Collection News and ELSOS, reviewed the FCC’s declaratory ruling confirming that Telephone Consumer Protection Act’s restrictions on the use of “artificial or prerecorded voice” include artificial intelligence technologies that mimic human voices and/or create calls with a prerecorded voice.
Purcell noted ACA members using AI technologies that replicate human voices on outbound calls will need prior express consent of the called party, similar to the TCPA’s requirements on using any automatic telephone dialing system or prerecorded voice call.
The conversation turned to how state regulators and legislators are approaching AI, which Madden said is a slow process involving studying the issue.
At the same time, technology used in the industry often falls under the definition of AI, making it an issue ACA is watching closely.
ACA is working on resources for members to connect on emerging threats and best practices in cybersecurity to help keep consumers’ data safe, Purcell said.
On the podcast, the group also talked about regulations from the Consumer Financial Protection Bureau that influence state activity, politicization of the bureau, state level legislation on garnishment and medical debt, among other topics. Purcell and Madden reviewed use of data on how the industry supports consumers’ access to credit.
